I’ve never been to Mexico’s San Miguel de Allende, a big outpost for Texans these days, but I know it’s popular. And UNESCO just designated it a world heritage site, officially blessing a 64-block historic district of 16th century homes, squares of buildings. The reason so many people like San Miguel is that it’s exceedingly U.S.-friendly — to the point where I’ve been told it’s now sort of a chunk of the U.S. within Mexico — BUT it still has this historic flavor, so you really feel like you’re in 16th century Mexico. An English-speaking 16th century Mexico. Right in the middle of the historic district, Dallas-based Rosewood Hotels and Resorts is working on the area’s first five-star resort, scheduled to open in fall 2010. It’s being built by Bald Mountain de Mexico in a design that I’m told will look very 16th century, with craft work by local artisans. It’ll be part hotel (63-suit Rosewood San Miguel de Allende) and part residences (Artesana Rosewood), as is the case with most high-end hotels these days. Has real estate market hit the bottom?
After more than two years of a steady downward slide, area mortgage and real estate professionals are cautiously hopeful that the federal bailout of the struggling Freddie Mac and Fannie Mae lending organizations will be the catalyst to bring the real estate market out of the doldrums. The first good sign came just a day after the federal government announced its plan when mortgage rates fell by about a half of a percent. But even before the announcement Sunday, several area real estate agents were cautiously optimistic that the market may be at, or near bottoming out. It is no secret that it’s been a tough few years in the real estate market. Ask just about anyone who has sold a home recently. And since a home purchase is where many Americans have their most money invested, when their home’s value drops, so does their net worth. Petoskey-based attorney and real estate agent Stefan Scholl, who tracks area real estate trends and writes an occasional blog on the subject his business’ Web site (www.buyersbroker.biz/blog) said numbers in the area — just like much of the nation — have been bad in the real estate market for some time. Doug Hoesli at Century 21 Up North in Boyne City, and Scholl said the slide in the real estate market has been a result of the struggling economy and risky investments in the mortgage industry putting people into bigger mortgages than they could realistically afford. That’s caused a huge spike in home foreclosures, which means banks are trying to get rid of homes they’ve foreclosed upon at fire sale prices. Those prices, in turn, drive down the prices of other homes in the market. “It’s a simple matter of supply and demand and right now we’ve got a lot more supply than there is demand,” Scholl said. “It’s definitely a buyer’s market.” In fact, Scholl looked up numbers showing that in the first eight months of 2008 about 100 of the 301 homes that have been sold in the Petoskey, Harbor Springs, Boyne City and Charlevoix markets have been foreclosure sales. During the same period of 2006 only 22 out of 341 were foreclosure sales. Shawn Haven, office manager at The Northern Credit Bureau in Petoskey said she and staff at the office started seeing a big upswing in foreclosures about two years ago. Many of the foreclosures were a result of people who had lost their jobs or suddenly were faced with a huge balloon payment on an adjustable rate mortgage or both. Numbers compiled by the Emmet Association of Realtors showed that for the first seven months of 2008, 541 sales were made in Antrim, Cheboygan, Charlevoix and Emmet counties. This is down by 15 (2.7 percent) from the same time frame last year and the median sales price was $129,900, down about $10,000 (7.1 percent) from last year. And while those numbers might not be significantly down, they are also down from two and three years ago. Chris Christensen an agent with Lynda’s Real Estate Service in Boyne City, estimated that on average, home values in Northern Michigan have dropped between 10 and 20 percent in the past three to four years...

Sales increase again for Naples real estate
For Naples Realtors it’s lucky No. 7. For seven moths in a row, real estate activity has been on the rise in the Naples area. In August, total sales increased to 370, from 293 a year ago, according to a monthly report by the Naples Area Board of Realtors. The report tracks home sales in Collier County, excluding Marco Island. It reflects sales made through the SunshineMLS, or multiple listing service. Naples also saw a 92 percent increase in pending sales, or sales that have yet to close. The median price for all homes continued to fall in August. It dropped to $238,000, from $375,000 a year ago. The median price is the price at which half the homes sell for more and half for less. Most of the activity is still being seen on homes priced at $300,000 or less. There were 222 sales made in this market last month...

A new tool for real estate buyers
Thailand's property market is still on the rise and highly competitive. Advertisements for new real estate developments are everywhere, and with them are promises of freebies. While some projects offer free air-conditioners, televisions and furniture, others promise gyms, swimming pools and even nurseries. Often such promotional gimmicks are not referenced in the purchase agreement. So what happens if, after project completion, the developer fails to deliver on its promises? The real estate company would, of course, refer to section 456 of the Civil and Commercial Code, which states that an agreement to sell or to buy any real estate property, or a promise to sell such property, is not enforceable unless there is some written evidence signed by the party liable. However, such companies fail to acknowledge a 2002 Supreme Court judgment (2729/2545) which stated that real estate companies who do not provide infrastructure as advertised are in default of the agreement. This ruling is typically interpreted as stating that real estate advertisements form an integral part of the agreement. This decision is one example of a law available to protect consumers better. In addition, in 2007 the Supreme Court, viewing that sufficient legal tools were not available for Thai consumers to defend themselves against unfair business practices, proposed the Consumer Case Procedure Act (the Act) to the National Legislative Assembly. The Act was passed in February 2008 and became effective on Aug 23, 2008. Under the Act, any law requiring the existence of a written and/or signed agreement prior to filing a court complaint, is not enforceable for consumers attempting to assert claims against business operators, provided that (1) the consumer has paid a deposit to the business operator, or (2) the consumer has performed part or all of his obligations under the agreement (Section 10). In addition, any announcement, advertisement, representation or act of a business operator that leads a consumer to understand, at the time of entering into the agreement, that the business operator will provide services or other infrastructure or perform certain additional services for the consumer, will be viewed as integral to the agreement between the consumer and the business operator (Section 11). Therefore, when purchasing property, if certain conditions or any understanding between the two parties are not set forth in the written agreements, it is important for property buyers to keep all brochures, flyers, information sheets, project layouts and other marketing materials, including pictures of billboards, relating to the projects. For a while San Miguel de Allende, Guanajuato's larger neighbor, was the only one that got property buyers' attention. However, buyers have recently begun trickling into Guanajuato as the prices in San Miguel rose out of their range. "San Miguel de Allende had been the place to buy property. In fact, it was not uncommon for a couple to come for a week's vacation and leave with a new home in their hands. The prices there have driven the market here," said Bower, who is also a longtime resident of the city. The real estate market in Guanajuato lacks homes that meet international buyers' standards, according to Calzada. The paltry supply of such properties makes available homes expensive, but prices are still reasonable when compared to other areas of the country, especially those on the coast. While the advantages of investing in Guanajuato include its obvious attractiveness to tourists from around the world, its location and steep streets can be limitations, according to Casas Eugenia. The city suffers from bouts of traffic jams but the government is investing in public transit. However, retirees, who make up a bulk of international property buyers in Mexico, may find the steep roads of Guanajuato hard to navigate if they are not in good health. Still, residential property prices in some areas of the city are rising by 15 to 20 percent per year. "Six years ago we looked at what we thought was a house of 'mansion' proportions. It was selling for $75,000. With a little work you could have had a money-maker by renting rooms. Now, something like that would be untouchable for all but the wealthy or someone who could get investment partners," said Bower. "Now, small and very dumpy looking houses are going for more than $200,000." Looking ahead Within the next five years, Guanajuato expects an expansion in the type of property the city offers, according to Calzada. This will give international buyers more choices, further encouraging them to invest in the city. "I anticipate the demographic to change rapidly. Moving to central Mexico used to be for retirees wanting to find a cheaper place to make their dollars stretch. This was true of [nearby] San Miguel, but the popularity too quickly altered the market's demographics and now it's the rich who can afford housing there. The same is rapidly happening in Guanajuato," said Bower, who has authored several books on moving to Mexico and learning Spanish. He said he worries about how the influx of international buyers could affect the unique atmosphere of the city that makes it such a wonderful place. SAN MIGUEL DE ALLENDE, Mexico - Travelers come to this town for the climate, the historic charm, the 16th- and 17th-century architecture, and the art. But navigating the cobblestone streets of the town can be treacherous, especially for women in heels. That's where Zapatería Martha comes to the rescue. Located just off the Jardin (the main square), Martha has been selling her husband's handmade "cocktail-combat" shoes for years. Think Birkenstocks (for comfort), but high style. Most are sandals (flat to not so flat) with solid rubber-like soles and colorful elastic uppers, most with a wide stretch band that gives support to the ankle. The shoes come in bright colors, both solid and striped. I bought one pair on my first visit to Martha's. The next day I bought another. At approximately $35 a pair, I regret not buying more. The shop is tiny and a bit in disarray, with a long bench down the middle for trying on shoes and two tiny aisles with floor-to-ceiling shoe boxes. Not all styles and colors are available in all sizes. But, if saving your ankles is important, this is the place to go.

SAN MIGUEL DE ALLENDE Hoteleros de San Miguel de Allende pronostican bajas importantes en este periodo vacacional; el presidente de la Asociación de Hoteles y Moteles y del municipio, Rubén Pérez Frydman, considera que la crisis económica de México y Estados Unidos, así como la problemática con las aerolíneas son lo que provoca esta disminución en la ocupación hotelera. Rubén Pérez Frydman, informó que el año pasado, durante este mismo periodo vacacional, la ocupación hotelera no llegó ni al 50 por ciento, pero este año consideran que están más lejos aún de alcanzar al menos esta cifra. Reconoció que hace dos años aún el evento de la Sanmiguelada era un respiro para todo el sector por la gran afluencia de turismo que se hacía presente esos días de septiembre, pero a raíz de que el evento se suspendió en el 2007, ahora no les resta más que esperar tiempos mejores. Explicó que pese a aún no tener cifras completas porque el periodo vacacional aún no ha terminado, pronostica que comparativamente con el año pasado habrá disminuido la ocupación hotelera un 5 por ciento, cifra que si impacto en la economía de los empresarios. Sobre las causas que esta baja podría tener, el presidente de los hoteleros consideró que en principio está la crisis económica que se vive en México y a nivel mundial, misma que ha afectado el bolsillo de todos. En segundo término mencionó la problemática que enfrentan las aerolíneas, como Aerocalifornia, y el incremento en el precio de la turbosina, que es el combustible que utilizan los aviones. Por otro lado señaló que de igual forma ha afectado la problemática de hipotecas y recesión económica de Estados Unidos, aunque reconoció que en esta ocasión la disminución es tanto de turistas extranjeros como nacionales.
